Terms of Service

PremiumGBP is operated by Lola Cascade Technologies, based in Okotoks, Alberta, Canada.

These Terms of Service form an agreement between you and Lola Cascade Technologies and govern your access to and use of PremiumGBP, including its website, assessments, reports, recommendations, generated assets, and related services.

By creating an account, purchasing a product, or using PremiumGBP, you agree to these terms.

If you do not agree to these terms, do not use PremiumGBP.

1. About PremiumGBP

PremiumGBP provides assessments, recommendations, written content, images, plans, and related resources intended to help businesses improve their Google Business Profile presence.

PremiumGBP is an independent product and is not affiliated with, endorsed by, or sponsored by Google.

Google, Google Business Profile, Google Maps, and related names and marks belong to their respective owners.

2. Eligibility

You must be legally capable of entering into a binding agreement to use PremiumGBP.

When using PremiumGBP on behalf of a business or organization, you confirm that you have authority to accept these terms on its behalf.

PremiumGBP is not intended for children.

3. Accounts

You agree to provide accurate and current information when creating and using an account.

You are responsible for:

• Maintaining the confidentiality of your credentials
• All activity conducted through your account
• Keeping your account and business information accurate
• Promptly notifying support of suspected unauthorized access
• Ensuring that anyone using the account is authorized to do so

Accounts may not be sold, transferred, shared publicly, or used to provide unauthorized access to another person or organization.

4. Information and materials you submit

You retain ownership of business information, text, images, trademarks, files, and other materials you submit.

You grant Lola Cascade Technologies a limited, non-exclusive right to host, process, reproduce, and analyse submitted materials only as necessary to:

• Operate PremiumGBP
• Provide requested outputs
• Maintain security
• Prevent abuse
• Improve service reliability

You confirm that:

• You own the submitted materials or have permission to use them
• The information is accurate to the best of your knowledge
• The materials do not violate another party’s rights
• You are authorized to submit information about the relevant business
• The materials do not contain unlawful or prohibited content

Do not submit passwords, complete payment card numbers, government identification numbers, health information, or other unnecessary sensitive information.

5. Generated content and recommendations

PremiumGBP may generate reports, recommendations, written content, images, plans, and other materials based on information provided by users.

Generated content is provided as a working resource and may contain errors, omissions, or unsuitable recommendations.

You are responsible for reviewing, editing, approving, and verifying all content before publishing or relying on it.

Lola Cascade Technologies does not guarantee:

• Approval of profile changes by Google
• Higher search rankings or Google Maps visibility
• Increased traffic, calls, leads, reviews, revenue, or sales
• Protection from profile suspension or enforcement action
• Continued availability of any Google feature
• Compliance of generated content without human review
• Any specific business, advertising, or financial result

Google and other platforms control their own rankings, policies, approvals, suspensions, and product features.

6. Permitted use

You may use PremiumGBP and its generated assets for your own business or for businesses you are authorized to represent, subject to the product or access level purchased.

You may edit, publish, and commercially use generated assets created for your account, provided that your use complies with applicable laws, platform rules, these terms, and third-party rights.

7. Prohibited use

You may not use PremiumGBP to:

• Impersonate another person or business
• Submit information about a business without authorization
• Create deceptive, fraudulent, defamatory, or misleading content
• Generate fake reviews or manipulate ratings
• Violate Google policies or other platform rules
• Infringe copyrights, trademarks, privacy rights, or other rights
• Upload malicious code or attempt to compromise PremiumGBP
• Access another user’s account or data
• Scrape, reverse engineer, copy, reproduce, or resell PremiumGBP itself
• Circumvent account, payment, access, or usage restrictions
• Use automated methods that place unreasonable demand on PremiumGBP
• Conduct unlawful, abusive, fraudulent, or harmful activity

8. Purchases and access

Prices, included features, usage limits, and product descriptions are displayed before purchase.

A completed one-time payment provides access to the product and deliverables described at checkout.

Unless the checkout page states otherwise, access is associated with the purchasing account and may not be transferred.

The current PremiumGBP offer includes up to five refinement requests for each eligible generated asset.

A refinement adjusts an existing asset. It does not include an unrelated replacement, a different business, or a substantially different project.

Lifetime access means access for as long as Lola Cascade Technologies continues operating and supporting the purchased PremiumGBP product.

Lifetime access does not guarantee that every current feature, integration, service provider, technology, model, or delivery method will remain unchanged permanently.

Lola Cascade Technologies may modify, replace, improve, or discontinue individual features where reasonably necessary while preserving access to the core purchased deliverables whenever practical.

9. Payments

Payments are processed by an external payment provider.

By making a purchase, you authorize the payment provider to charge the amount shown at checkout, including applicable taxes.

You are responsible for providing accurate billing information and for any fees charged by your bank, card issuer, or payment provider.

Access may be delayed, suspended, or cancelled if payment is incomplete, reversed, disputed, fraudulent, or unauthorized.

10. Refunds

Refund requests may be submitted within seven calendar days after purchase through Contact Support.

A refund may be refused where:

• A substantial portion of the purchased assessment, report, or generated assets has already been delivered
• The account has downloaded, exported, published, or materially used the deliverables
• The request involves abuse, fraud, repeated purchases and refunds, or a payment dispute
• The user violated these terms

Nothing in this section limits mandatory consumer rights that cannot legally be excluded.

Approved refunds are returned through the original payment method and may require additional processing time from the payment provider.

11. Intellectual property

PremiumGBP, including its website, interface, branding, software, workflows, templates, underlying systems, and original service content, is owned by Lola Cascade Technologies or its licensors and is protected by applicable intellectual-property laws.

Purchasing access does not transfer ownership of the PremiumGBP platform, source code, systems, brand, workflows, or underlying templates.

Your rights to generated assets remain subject to:

• These Terms of Service
• Applicable law
• Third-party rights
• Restrictions imposed by technology providers used to produce them

12. Third-party services

PremiumGBP relies on third-party services for hosting, authentication, payments, automated content generation, analytics, and related infrastructure.

The availability and operation of these services may affect PremiumGBP.

Lola Cascade Technologies is not responsible for outages, policy changes, account decisions, ranking changes, or service limitations controlled by Google or another third party.

Your use of external platforms remains subject to their own terms and policies.

13. Availability and service changes

Lola Cascade Technologies aims to maintain a reliable service but does not guarantee uninterrupted, error-free, or permanently available access.

We may update, maintain, restrict, or temporarily suspend parts of PremiumGBP for security, technical, legal, operational, or product reasons.

We may update these terms when PremiumGBP or applicable requirements change.

Updated terms will be posted with a revised effective date.

Continued use after an update constitutes acceptance of the revised terms where permitted by law.

14. Suspension and termination

Lola Cascade Technologies may restrict or terminate access when reasonably necessary because of:

• A material violation of these terms
• Fraudulent, unlawful, abusive, or harmful activity
• Unauthorized access or security concerns
• Payment reversal, dispute, or fraud
• Misuse of third-party services
• Legal or regulatory requirements
• Conduct that may harm PremiumGBP, Lola Cascade Technologies, its users, or another party

Where appropriate, we may provide notice or an opportunity to correct the issue.

Serious security, fraud, abuse, or legal matters may require immediate action.

You may stop using PremiumGBP at any time.

Refund eligibility remains governed by the refund section above.

15. Disclaimers

PremiumGBP is provided on an “as available” and “as is” basis to the maximum extent permitted by law.

PremiumGBP provides general business-profile information and content assistance.

PremiumGBP does not provide legal, tax, accounting, financial, or professional compliance advice.

You remain responsible for:

• Business decisions
• Published content
• Google Business Profile changes
• Platform compliance
• Information provided to customers or third parties
• Confirming the accuracy and suitability of generated recommendations

16. Limitation of liability

To the maximum extent permitted by law, Lola Cascade Technologies will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including:

• Lost revenue
• Lost profits
• Lost data
• Lost opportunities
• Business interruption
• Ranking changes
• Profile suspension
• Reputational harm

To the maximum extent permitted by law, the total liability of Lola Cascade Technologies arising from a claim related to PremiumGBP will not exceed the amount paid by you for the product giving rise to the claim during the twelve months before the event that caused the claim.

These limitations do not exclude liability that cannot legally be limited or excluded.

17. Indemnification

To the extent permitted by law, you agree to defend and indemnify Lola Cascade Technologies against third-party claims, damages, losses, and reasonable costs arising from:

• Materials you submit
• Content you publish
• Your use of PremiumGBP
• Your violation of these terms
• Your violation of applicable law or platform rules
• Your violation of another party’s rights

18. Governing law

These terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be submitted to the courts located in Alberta, Canada, unless applicable consumer law requires otherwise.

19. Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in effect.

The unenforceable provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted by law.

20. Entire agreement

These Terms of Service, together with the Privacy Policy and any terms displayed at checkout, constitute the entire agreement between you and Lola Cascade Technologies regarding your use of PremiumGBP.

If there is a conflict between these Terms of Service and specific terms displayed at checkout, the checkout terms will govern the relevant purchase.
